Alternate Dispute Resolution

Eric D. Brophy, Partner, oversees DIEGNAN & BROPHY, LLC’s, Alternate Dispute Resolution Practice Group.  As an approved Rule 1:40 New Jersey Superior Court Mediator Mr. Brophy brings a wealth of experience to resolving matters before they become financially burdensome.  It remains D & B’s core belief that clients are almost always best represented when they have a hand in the outcome of a matter.  Leaving a matter up to a judge or administrative body always leaves one party unhappy with a result.  Successful negotiation only occurs when parties have an open mind and are motivated to settle.

Mr. Brophy has successfully negotiated many court-assigned matters and has mediated cases in Monmouth, Ocean, Union and Middlesex Counties.

D & B’s ADR Group helps parties achieve what they already desire, a settled case.  Acting as a facilitator, a mediator can guide parties down paths they did not see or were not able to navigate without a detached, third party on board.

Our ADR Group works closely with our Community Association Law Group in homeowner dispute matters.  The New Jersey Condominium Act requires that all community associations provide a method of ADR to be administered by the Association.  D & B also utilizes the efforts of Community Dispute Resolutions, LLC, a local dispute resolution company specializing in community association law, in order to help homeowners and association boards resolve their disputes.
